Welcome to aksziii.com (“Website”). These Terms & Conditions (“Terms”) govern your use of our Website and services, and form a binding agreement between you (“You” or “User”) and AX Data Solutions B.V. (KvK nr 91949025) (“the Company,” “We,” “Us,” or “Our”). By accessing or using the Service, you agree to these Terms. If you disagree with any part, please do not use the Service.

 

Definitions

  A unique account you create to access parts of our Service (e.g. purchase history, order tracking).
• Affiliate
  An entity under common control (50%+ ownership).
• Device
  Any computer, mobile, or tablet used to access the Service.
• Intellectual Property
  All trademarks, logos, designs, text, images, audio, video, code and other content on the Website.
• Promotions
  Discounts, coupons, vouchers or other special offers that We may offer from time to time.

  The Website and any related online services (e.g. checkout, account area).
• You

Accounts, Privacy & Eligibility

• Registration
  You may register for an Account by providing a valid email address and password.
• Age
  You must be at least 18 years old to create an Account.
  If you are under 18, you may still place orders as a Guest at checkout, provided you have parental or legal guardian consent.
• Security
  You are responsible for maintaining the confidentiality of your Account credentials and for all activity under your Account.

  Your access to and use of the Service is also conditioned on your acceptance of our Privacy Policy. Please review it carefully.

 

Purchases & Payments

• Products
  We sell lenticular posters and related art goods. All orders are subject to acceptance and availability.
• Checkout
  To purchase, add items to your cart, proceed to checkout, and submit payment via the available gateway (e.g. Stripe).
• Pricing & Taxes
  All prices are in EUR and exclude applicable VAT and shipping costs, which will be calculated at checkout.
• Order Confirmation
  Upon successful payment, you will receive an order confirmation by email. Title to the goods passes to you upon delivery.
• Promotions
  We may offer Promotions with specific terms (expiry date, one-time use). Only one Promotion can be applied per order unless otherwise stated.
• Guest Checkout
  You may purchase Products either as a registered user with an Account or as a Guest without registering.
• Age Representation
  By placing an order (Account or Guest), you represent that you are at least 18 years old or have obtained parental/legal guardian consent to enter into a binding contract with the Company.
• Returns & Refunds

• Shipping & Delivery
  For full details on carriers, costs, delivery estimates and import duties, please see our Shipping Policy. We arrange shipping via the carrier(s) you select at checkout. Shipping costs and estimated delivery times are shown at checkout. Title and risk transfer to you upon delivery.
• Pricing Errors
  We reserve the right to correct any pricing or typographical errors on the Website prior to order fulfillment. If an error is discovered after you place an order, we will contact you to confirm whether you wish to proceed at the correct price or cancel.

 

Intellectual Property

• All content on the Website – logos, graphics, text, images, designs, code and “look and feel” – is the exclusive property of the Company or its licensors.
• You may view and download extracts of our content for personal, non-commercial use only.
• Any unauthorized reproduction, modification, or redistribution of our Intellectual Property is strictly prohibited.

 

User Feedback & Suggestions

• You may submit feedback, ideas or suggestions (“Feedback”) via our contact form or email.
• By submitting Feedback, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, modify, publish and commercialize that Feedback without compensation or attribution.

 

Promotions & Coupons

We may run occasional Promotions (discount codes, flash sales, seasonal offers). Terms for each Promotion – eligibility, validity period, usage limits – will be posted alongside the code. The Company reserves the right to modify or cancel any Promotion at any time.

Our Service may link to third-party websites. We have no control over, and assume no responsibility for, their content, policies, or practices. You should review their terms and privacy policies before using those sites.

 

Termination

We may suspend or terminate your Account and access to the Service at any time, without notice, for any breach of these Terms.

 

Limitation of Liability

To the maximum extent permitted by law, the Company’s total liability is limited to the amount you paid for the product(s) giving rise to the claim or €100, whichever is greater. In no event shall we be liable for any indirect, incidental, or consequential damages.

 

Indemnification

You agree to indemnify and hold harmless AX Data Solutions B.V., its officers, directors, employees and agents from any claims, losses, liabilities, damages, costs or expenses (including reasonable legal fees) arising out of or in connection with your use of the Service or any violation of these Terms.

 

Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations under these Terms to the extent that such delay or failure is due to events beyond its reasonable control, including acts of God, war, terrorism, strikes, epidemics, or government orders.

 

“AS IS” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. We expressly disclaim all implied warranties, including merchantability and fitness for a particular purpose.

 

Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands. Any disputes shall be first raised informally; if unresolved, you agree to submit to the exclusive jurisdiction of the Dutch courts.

 

Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable under applicable law, such provision shall be struck out and the remaining provisions shall remain in full force and effect. No waiver by the Company of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default.

 

Entire Agreement

These Terms, together with the Privacy Policy, Refund & Returns Policy, Shipping Policy and Cookie Policy constitute the entire agreement between you and AX Data Solutions B.V. regarding the Service and supersede all prior or contemporaneous agreements, understandings, and communications.

 

Changes to These Terms

We may update these Terms at our discretion. Material changes will be notified via email or prominent notice on the Website at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
